If you miss a traffic court date in North Carolina, the court may mark your case "called and failed." The next steps depend on the charge and case status. An order for arrest can be issued in some cases, so the reporting deadlines discussed below should not be treated as permission to delay addressing the case.

What Failure to Appear Means Under NC Law

Under G.S. 20-24.2, the court generally reports a missed appearance for a motor vehicle offense to NCDMV if the person has not appeared to answer the charge or disposed of it within 20 days after the scheduled appearance. Under G.S. 20-24.1, a resulting revocation order takes effect on the 60th day after it is mailed or personally delivered. Revocation is not immediate on the missed court date.

A $200 failure-to-appear fee may apply under G.S. 7A-304(a)(6), subject to its 20-day exception and available court relief. An order for arrest or bond forfeiture is possible depending on the case. G.S. 20-24.1 governs license revocation; it does not itself create an additional criminal charge for every missed traffic court date.
